These Terms and Conditions apply to the use of the website skincancercheckup.com (hereinafter 'DermCheck') operated by Philipp Schmid, Steinenberg 10, 88339 Bad Waldsee, Germany. By using the website, you accept these terms.
DermCheck offers the following services:
DermCheck does not provide a medical diagnosis and is not a medical device within the meaning of Regulation (EU) 2017/745. The AI analysis provides solely an indicative risk assessment based on a photo. It can neither replace nor anticipate a medical examination and is in particular not suitable for establishing or ruling out a disease. A finding classified as low risk is expressly not an all-clear. Seek medical advice whenever there is a change, whenever you are uncertain and whenever you have symptoms, irrespective of the result of the analysis, and immediately if skin cancer is suspected. The assessment by dermatologists arranged via DermCheck is likewise made solely on the basis of the photos submitted, without an in-person examination, and does not constitute treatment.
A paid contract is formed when you book an advanced AI report or a dermatologist review after the AI analysis and successfully complete payment via Stripe. Confirmation is sent by email.
The AI analysis is free; for a scan with up to 5 photos the advanced AI report is included at no cost. For paid services, the prices displayed at the time of ordering apply: advanced AI report for scans with more than 5 photos €4.99 (one-time, automatically generated digital report, provided immediately after payment), dermatologist review Standard €19.99 (reply within 48 hours) and Express €39.99 (reply within 24 hours). As a small business under Section 19 of the German VAT Act (UStG), no VAT is charged or shown. Payment is made exclusively through the payment service provider Stripe.
Payment processing is handled via Stripe Checkout. Common payment methods (credit card) are accepted. DermCheck does not store payment data - this is processed exclusively by Stripe.
Consumers have a statutory right of withdrawal. You will find the details and the model withdrawal form in our withdrawal policy. In the case of digital content that we make available immediately (Advanced AI Report), the right of withdrawal expires pursuant to § 356 Abs. 5 BGB if you have expressly agreed that we begin performance before the withdrawal period expires, you have confirmed your knowledge of the expiry of that right and we have provided you with this confirmation. In the case of services (dermatologist review), the right of withdrawal expires pursuant to § 356 Abs. 4 BGB only upon complete performance, provided that you have previously expressly requested that we begin before the period expires and have confirmed your knowledge of the loss of the right of withdrawal. For the annual access, the right of withdrawal exists for fourteen days; for services rendered up to that point you owe compensation for value if you requested that performance begin early.
Registered dermatologists can review skin lesions via the physician portal. Compensation is €5.00 per review and is paid out via Stripe Connect. Minimum payout amounts and further details are displayed in the physician dashboard. DermCheck reserves the right to reject or revoke physician registrations.
We are liable without limitation in cases of intent and gross negligence, for injury to life, body or health, for the fraudulent concealment of a defect, to the extent of a guarantee assumed and under the German Product Liability Act (Produkthaftungsgesetz). In the event of a slightly negligent breach of a material contractual obligation, liability is limited to the damage that is foreseeable at the time the contract is concluded and typical for this type of contract. Material contractual obligations are those obligations whose fulfillment is what makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. Liability is otherwise excluded. These provisions also apply for the benefit of our legal representatives and vicarious agents.
The annual access has a term of twelve months from the conclusion of the contract. It is automatically extended by twelve months at a time unless it is cancelled by the end of the respective term. After the first extension you can cancel at any time giving one month's notice (§ 309 Nr. 9 BGB). Cancellation is possible at any time via the “Cancel contract here” button in your account and also informally by email. The right to terminate for good cause without notice remains unaffected. We will inform you by email of the applicable price and the date of the next debit before the extension takes effect.
The law of the Federal Republic of Germany applies. The place of jurisdiction, insofar as legally permissible, is Bad Waldsee. Should individual provisions of these terms be invalid, the validity of the remaining provisions shall remain unaffected.
The language of the contract and of proceedings is German. Translations of these terms are provided solely for your information. In the event of discrepancies between the German version and a translation, the German version shall prevail.
